GENERAL CONTRACTUAL CONDITIONS OF THE RIOMAR HOTEL
RESERVATIONS SYSTEM

BALCAR S.L (Henceforth, HOTEL RIOMAR) offers this site for USERS (understood to mean visitors to this web page), conditional on the acceptance without modification of the visitor (henceforth the USER) to the General Contractual Conditions and Conditions of Use (henceforth, CONDITIONS) laid down here.

A visit to the www.hotelriomar.com page, the use of any of the sections of the same, as well as the use of the RESERVATIONS SYSTEM by the USER is understood to mean that the USER assumes, without limitation, the obligations laid down in these CONDITIONS.

The USER declares that s/he is of legal age (that is to say that s/he is at least 18 years old) and has the legal capacity to agree to these conditions and use this web site in conformance with the CONDITIONS herein, that s/he understands in their totality.

The USER also declares that all information supplied by him/her to this web page, and in the course of using the reservations system, is true, complete and exact, and s/he agrees to keep it up to date.

The HOTEL RIOMAR reserves the right at any time, and without notification, to modify and update services offered, either relating to the information contained in these CONDITIONS or any substantial aspect of this page.

Balcar, S.L (Henceforth HOTEL RIOMAR) is a company registered in the Balearic business registry, folio 18, volume 1359 of companies, sheet number PM 23279, registration 9, with CIF B-07.00.77.84 .

The registration number is included on the island registry of companies, activities and tourist establishments.

3.1 • General considerations

• Rooms reserved may not be occupied before midday on the arrival date.
• Rooms must be vacated before midday on the departure date.
• Reservation prices do not include VAT (7%).
• The reservation will be confirmed upon receipt of 40% of the total value of the reservation.
• No payment is necessary for children under two.
• The cot service is provided free of charge by the hotel management.
• Children from 2 to 12 years old will be considered as children and not adults.

3.2 • Steps To Confirm Reservation

The USER may make an on-line reservation by following these steps:

STEP 4: CONFIRMING THE RESERVATION

STEP 1: CHECKING AVAILABILITY

The USER will check availability of rooms in the HOTEL RIOMAR via the HOTEL RIOMAR, database, choosing the month and arrival date, the number of nights and type of stay – half board or bed and breakfast. The user will then click on “Check availability”

Reservations must be made for at least 7 nights and no longer than 15 nights. For stays shorter than 7 nights and longer than 15 nights, the USER can contact the customer attention department of the HOTEL RIOMAR, by clicking on the relevant link. The USER will access the customer attention department and must complete a form with his or her e-mail, name, fax or telephone number, arrival date, number of nights and type of room.

STEP 2: SELECTING THE TYPE OF ROOM AND NUMBER OF PERSONS

If there are no free rooms for the period requested, the USER will see a screen informing him of this and suggesting he contact the hotel by filling in a form with his name, e-mail, fax or telephone number, arrival date, the number of nights and type of room. Alternatively he may check for different nights.

If the HOTEL RIOMAR has rooms available for the days requested, the USER will see a list of available rooms. The USER must choose the type of room s/he wishes to reserve and the number of persons that will be staying (number of adults, number of children), by using pull down menus. Children under 2 do not have to pay for their stay. Cot service is provided free of charge by the Hotel management to guests with a baby. Children aged from 2 to 12 will be considered as children and not adults.

If the rooms available for the period do not meet the requirements of the USER s/he may make a further consultation.

If the USER wishes to make a reservation then s/he must click on the ‘reserve' option which will appear.

STEP 3: MAKING THE RESERVATION AND MEANS OF PAYMENT

The USER will go to a screen containing details of the reservation s/he wishes to make, the arrival date, the number of nights, type of room, number of adults, number of children, total amount without VAT and the total cost of the stay at the HOTEL RIOMAR.

Finally, the quantity to pay to confirm the reservation appears, which must be deposited to the HOTEL RIOMAR to confirm the reservation. The amount payable with be equivalent to 40% of the total amount.

If the USER finds that any details are incorrect, s/he may modify said details by clicking on the ‘here' button at the beginning of the screen.

If the USER agrees with the reservation details, s/he must provide the additional data required on the form – name, surname, address, post code, e-mail, fax or telephone, time of arrival, number of babies and any additional comments about the reservation.

These personal details will be dealt with in accordance with the hotels' privacy policy.

The USER may confirm the reservation by using three different payment methods:

1, By credit card, though the secure payment system (henceforth, SPS) of the Sa Nostra Bank of the Balearic Islands.
2, By bank transfer
3, By faxing the number of your credit card

The USER can choose the means of payment and click on “Pay”

STEP 4: CONFIRMATION OF THE RESERVATION

The confirmation of the reservation will be made in different ways, depending on the payment method chosen by the USER.

1: On-line payment via SPS of Sa Nostra

The USER will access the virtual SPS of the Sa Nostra bank. The SPS guarantees security and confidentiality of details provided, through 128 bit encryption.

Cards accepted are: MasterCard, Visa, Maestro, 6000 Card, Euro 6000.

The USER must enter the credit card number and expiration date. The USER must click on ‘pay' to confirm the reservation.

The USER will then move to the confirmation screen containing all relevant details and the reservation code.

The USER must retain the reservation code in case s/he later wishes to cancel the reservation.

The USER will receive confirmation of the reservation and related details by e-mail.

2: Payment by bank transfer

The USER will move onto a screen containing reservation details and the reservation code to be kept for any later operations.

The deposit of the total for the reservation should be made into the HOTEL RIOMAR account, indicating the reservation code for reference.

Once the reservation has been made the USER must send documentation of the transfer by Fax to: (+34) 971 33 28 26 within 5 days, stating the reservation code.

The reservation will be automatically confirmed by e-mail.

If the USER does not send said documentation within 5 days, the reservation will be cancelled automatically.


3: Sending the credit card number by fax.

The USER will move to a screen where s/he must fill in reservation details and the reservation code.

To confirm the reservation the USER must send the credit card number and reservation code to (+34) 971 33 28 26 within 24 hours.

If the USER does not send the fax within 24 hours of the reservation it will be cancelled automatically.

The reservation will be confirmed automatically by e-mail.

3.3 • Cancellations policy

The HOTEL RIOMAR agrees to use by the USER of the reservation cancellation system under the following conditions:

The USER may cancel the reservation from the www.hotelriomar.com , web page. ‘Reservations' section, clicking on the ‘cancel reservations' option.

The USER will then move to a screen where s/he will enter the reservation code and his or her surname.

Cancellation of the reservation will be confirmed by e-mail after being checked by the customer service department of the HOTEL RIOMAR.

For cancellations by the USER 15 days before the arrival date at the RIOMAR, any money deposited will be reimbursed.

For cancellations made by the USER within 15 days of the arrival date to the HOTEL RIOMAR, 50% of the payment made to the HOTEL RIOMAR will be made.

If the cancellation is made within24 hours of the arrival date or the USER doesn't show up, then the total paid will not be reimbursed.

3.4 • Last Minute Offers

The HOTEL RIOMAR may make last minute offers available when it judges suitable.

When the HOTEL RIOMAR makes “LAST MINUTE OFFERS”, the USER can see these on the left side of the screen on the www.hotelriomar.com web page.

To access “LAST MINUTE OFFERS”, the USER must click on the option.

The USER will move to the page “check availability” and enter the dates available for the offer.

The USER must then follow the steps specified in the section: 3.2. STEPS FOR CONFIRMING RESERVATIONS.

4.1 The USER declares that s/he is of legal age (that is to say that s/he is at least 18) and has the legal capacity to make this agreement and use this web site in conformance with the CONDITIONS herein, that s/he understands in their totality.

4.2 The USER also declares that any information provided to this web site and in the course of using the reservations system is true, complete and accurate, and s/he agrees to keep it up to date.

4.3 The USER agrees to use this web site and the services provided in conformance with the law, morals, good custom and public order.

4.4 The USER agrees not to use this web site for illegal or prohibited ends.

4.5 The USER is prohibited from modifying, reproducing, duplicating, copying, distributing, selling, reselling or otherwise exploiting the contents of this web page, whether for commercial gain or not.

4.6 USERS of www.hotelriomar.com must follow any instructions received from the www.hotelriomar.com web site or hotel personnel.

5.1 Any notification by any of the parties must be made by any method allowing the reasonable belief that this information has arrived securely, possibly by e-mail.

5.2 Any notification by the USER to the HOTEL RIOMAR may be made via the following e-mail address: info@hotelriomar.com

If any disposition of the current CONDITIONS is considered null, legal or unenforceable, the validity, legality or enforceability of the remaining stipulations will not be affected or prejudiced.

7.1 The CONDITIONS herein are to be interpreted according to current Spanish legislation.

7.2 In order to resolve any disagreement as to these CONDITIONS, both parties will submit to the jurisdiction of the Ibiza courts, expressly renouncing any other corresponding legal jurisdiction.

For the effects of the protection of personal data, organic law 15/1999, of the 13 th of December relating to protection of personal information,

Balcar S.L (henceforth the HOTEL RIOMAR), informs USERS of automated processing of any personal information requested in the following sections: Contact us, we improve with you, cancellation of reservations, Customer service, reservations and subscription to the Hotel Riomar newsletter.

Users are also informed of the inclusion of said data into an automated filing system for personal data, registered in the Spanish data protection agency.

The Hotel Riomar is responsible for this file. Any information provided will be treated confidentially and will not be provided to third parties in any situation.

For minors, parental consent is required before completing personal details in the specified sections.

The aims of automated collection of personal data are:

• Effective management of reservations made through the web page using any of the means of payment.

• The management of requests for information made through the contact us and we improve with you section of www.hotelriomar.com web page.

• To send advertising and information of offers and promotions at the HOTEL RIOMAR.
